Bolt & Seam, operated by François Durocher ("Bolt & Seam," "we," "us"), operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase using the Services, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Please read this Privacy Policy carefully. By using or accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described here.
Person Responsible for the Protection of Personal Information
Under Québec's Act respecting the protection of personal information in the private sector (Law 25), Bolt & Seam has designated a person responsible for the protection of personal information:
François Durocher
Bolt & Seam
52 avenue de Baccarat
Lorraine, Québec J6Z 3A9, Canada
info@boltandseam.com
You may contact this person to access, correct or delete your personal information, to withdraw your consent, or to file a complaint about our privacy practices. We respond within 30 days. If you are not satisfied with our response, you may file a complaint with the Commission d'accès à l'information du Québec (cai.gouv.qc.ca).
Personal Information We Collect or Process
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information collected anonymously or de-identified so that it cannot identify or be reasonably linked to you. Depending on how you interact with the Services, where you live, and as permitted or required by applicable law, we may collect or process the following categories of personal information, including inferences drawn from it:
- Contact details including your name, address, billing address, shipping address, phone number, and email address.
- Financial information including payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details. We never see or store your full card number; payments are processed by Shopify Payments and other payment providers.
- Account information including your username, password, preferences and settings.
- Transaction information including the items you view, add to your cart or wishlist, purchase, return, exchange or cancel, and your past transactions.
- Communications with us including the information you include when you send a customer support inquiry or reply to our emails.
- Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
- Usage information including how and when you interact with or navigate the Services.
Where This Information Comes From
- Directly from you when you create an account, place an order, use the Services, communicate with us, or otherwise provide us with your personal information.
- Automatically through the Services from your device when you visit our store, and through cookies and similar technologies.
- From our service providers when we engage them to enable certain technology, or when they collect or process personal information on our behalf.
- From our partners or other third parties, such as advertising and analytics providers.
How We Use Your Personal Information
- To provide, tailor and improve the Services. To perform our contract with you: process your payments, fulfil your orders, arrange shipping, handle returns and exchanges, remember your preferences, send notifications about your account and orders, enable you to post reviews, and create a shopping experience suited to you, such as recommending products related to what you have viewed or bought.
- Marketing and advertising. To send marketing and promotional messages by email or text where you have consented, and to show you online advertisements for our products, including based on items you have previously viewed or added to your cart. You can withdraw consent at any time.
- Security and fraud prevention. To authenticate your account, provide a secure payment and shopping experience, and detect, investigate or act on possible fraudulent, illegal or malicious activity. If you register an account, you are responsible for keeping your credentials safe; please do not share your password with anyone.
- Communicating with you. To provide customer support, answer your questions, and maintain our business relationship with you.
- Legal reasons. To comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, and to enforce or investigate potential violations of our terms or policies.
Print-on-Demand and Order Fulfilment
Our products are printed to order rather than held in stock. To make and deliver your order, we share your name, shipping address, order contents and contact email with our production and fulfilment partner, Printify, and with the print facility that produces your order. Those facilities may be located in Canada, the United States, or Europe, and your information is transferred and processed there for the sole purpose of manufacturing and shipping your order. We also share your address with the shipping carrier so your parcel can be delivered and tracked. We do not sell your personal information.
How We Disclose Personal Information
In certain circumstances we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy:
- With Shopify, Printify, and other vendors who perform services on our behalf — payment processing, IT management, data analytics, customer support, cloud storage, printing, fulfilment and shipping.
- With business and marketing partners who provide marketing and advertising services. For example, we use Shopify to support personalised advertising with third-party services based on your online activity across merchants and websites. These partners use your information in accordance with their own privacy notices. Depending on where you live, you may have the right to direct us not to share information about you for targeted advertising — see Your Rights and Choices below.
- When you direct, request or otherwise consent to disclosure — for example when you use a social media widget or a login integration.
- In connection with a business transaction such as a merger, acquisition or bankruptcy; to comply with legal obligations including subpoenas and search warrants; to enforce our terms; and to protect the rights of Bolt & Seam, our customers, or others.
Cookies and Similar Technologies
We use cookies to keep your cart and session working, to understand how the store is used, and — with your consent — to measure and personalise advertising. Cookies that are not strictly necessary to operate the store are switched off until you accept them.
You can change your choice at any time through the cookie preferences link in our footer, or by clearing cookies in your browser settings. Declining optional cookies will not prevent you from browsing the store or placing an order.
Our Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services is transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside. Shopify also offers enhanced features that use data from your interactions with our store, other merchants, and Shopify itself. In those circumstances Shopify is responsible for processing your personal information, including responding to requests to exercise your rights. To learn more, see the Shopify Consumer Privacy Policy at privacy.shopify.com.
Third-Party Websites and Links
The Services may link to websites or platforms operated by third parties, including social media. If you follow a link to a site we do not control, review its privacy and security policies before using it; we are not responsible for the privacy or security of those sites or the accuracy of information found there. Information you share on public or semi-public venues, including third-party social platforms, may be viewable by others. Our inclusion of a link does not imply endorsement.
Children's Data
The Services are not intended for children, and we do not knowingly collect personal information from children under the age of majority in their jurisdiction. If you are the parent or guardian of a child who has provided us with personal information, contact us using the details below and we will delete it. As of the date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.
Security and Retention of Your Information
We take reasonable measures to protect your personal information, but no security measure is perfect or impenetrable, and information sent to us over the internet may not be secure while in transit. Please do not use unsecured channels to send us sensitive or confidential information.
How long we keep your personal information depends on why we hold it. As a general rule: order and transaction records are kept for seven (7) years to meet Canadian tax and accounting obligations; account information is kept for as long as your account is open; marketing contact details are kept until you unsubscribe or ask us to delete them; and support correspondence is kept for two (2) years. When information is no longer needed, we delete or anonymise it.
Confidentiality Incidents
If a confidentiality incident occurs involving your personal information and it presents a risk of serious injury, we will notify you and the Commission d'accès à l'information du Québec promptly, as required by Law 25, and we will take reasonable measures to reduce the risk of harm and prevent similar incidents.
Your Rights and Choices
Depending on where you live, you may have some or all of the rights below. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline a request as permitted by law.
- Access. Request access to the personal information we hold about you.
- Deletion. Request that we delete personal information we hold about you.
- Correction. Request that we correct inaccurate personal information.
- Portability. Receive a copy of your personal information in a structured, commonly used technological format, and ask us to transfer it to a third party, in certain circumstances.
- Withdrawal of consent. Withdraw consent to processing that relies on it, including marketing, at any time.
- De-indexing. Under Law 25, request that we stop disseminating your personal information or de-index a link to it where dissemination causes serious injury to your reputation or privacy.
- Opt out of sale, sharing, or targeted advertising. Depending on where you live, you may opt out of the "sale" or "sharing" of your personal information or of processing for targeted advertising, using the cookie preferences link in our footer, or by contacting us. If you visit our website with the Global Privacy Control signal enabled, we will treat it as an opt-out request for that browser and device where required. We do not respond to other "Do Not Track" signals.
- Communication preferences. Opt out of promotional emails at any time using the unsubscribe link in any message. We may still send non-promotional messages about your account or orders.
To exercise any of these rights, contact our person responsible for the protection of personal information using the details above. We will not discriminate against you for exercising your rights. We may need to verify your identity before processing a request, as permitted or required by law. You may designate an authorised agent to make a request on your behalf; we will require proof of that authorisation. We respond within the time frame required by applicable law, and within 30 days for requests under Law 25.
Complaints
If you have a complaint about how we handle your personal information, contact us using the details below and we will look into it. If you are not satisfied with our response, you may lodge a complaint with the Commission d'accès à l'information du Québec (cai.gouv.qc.ca), the Office of the Privacy Commissioner of Canada (priv.gc.ca), or, if you live elsewhere, your local data protection authority.
International Transfers
We may transfer, store and process your personal information outside the province and country where you live, including in the United States and Europe, because our hosting, payment, printing and fulfilment partners operate internationally. Before any such transfer we assess whether the information will receive adequate protection, and we require our partners to protect it by contract.
If we transfer personal information out of the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission's Standard Contractual Clauses, or the equivalent issued by the competent UK authority, unless the destination country has been determined to provide an adequate level of protection.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for operational, legal or regulatory reasons. We will post the revised policy on this page, update the "Last updated" date, and provide notice where required by applicable law.
